Sexual Harassment & Hostile Work Environment Complaint Against JJ Walsh Sent Directly To County Executive
Attorneys for Stacey Bailey filed a motion for sanctions to the US District Court last Friday, stating that the Fire & Rescue Department did not comply with a court order to supply all sexual harassment and hostile work environment complaints to the plaintiff. The motion contained a detailed hostile work environment and sexual harassment complaint against Deputy Fire Chief JJ Walsh, which was emailed directly to the County Executive on April 7, 2011. A follow up email was sent to the County Executive on April 20, 2011, asking him to investigate the details of the complaints. To our knowledge, the County Executive never responded to the complaint emails.
The complaint that was sent to the County Executive, contains a long list of alledged improper actions and statements made by Walsh. The complaints include making several vulgar statements about female firefighters, hostile and intimidating arguments with FRD employees, as well as a sexual affair Walsh is said to have had with the wife of a FRD Captain.
The motion also states that the FRD did not take any action on certain complaints, and were selective about investigating others. I should warn you - the graphic details of the complaints against DFC Walsh are disturbing.

It's easy to post comments when you don't leave your name. I read the Bailey lawsuit and most is probably fabricated or sensationalized, but I'm sure there is some truth. Unless you actualy saw what happened, you don't know for sure. Remember Richard Jewel? Duke Lacrosse?
I'm not excusing poor behavior, just the opposite. Accusations have been made, lets give a chance for a defence.

It took awhile, but I got the megaupload to work. I was able to view and print and save the document.
I worked with JJ for a short time and he wasn't too bad; the key I think was I was a Captain II and he was a LT. Once we both made BC, I had several issues with him and was close to filing formal charges against him myself. (I wanted to issue him a formal ass beating, which may not have cured him of being the ultimate douchebag, but would sure have made me feel better)
I am now retired and have been out of the loop awhile. The charges against him are pretty severe. Even if only a fraction of them are true, it still paints a bad picture. I assume Deli is still BC401A. He was always a top notch officer, so if JJ is going off on him, he has lost his mind.

The complaints are egregious, detailed and numerous. No one who has spent more than a few minutes around JJ would have trouble believing these allegations. Now that a few have been brave enough to come forward, I hope everyone that has been wronged by this Neanderthal (and his cronies) comes forth to be heard.
As far as the actions to be taken? I think first off, his as well as anyone else involved who is on probation, should have that probation extended until this is resolved (if the info he is still on probation is correct).
Secondly, this is such a complex myriad of issues I think counsel completely independent of the "Good Old Boy" network (similar to what was done with the Charleston Sofa Super Store Fire) should be commissioned to investigate not only JJ but also everyone named in these allegations of multiple eruptions of unprofessional and sometimes illegal misconduct. I think all of the stones need to be overturned to identify and separate the real issues from the fabricated ones and squash all of the rumors with the transparency of the truth.
This is a huge black eye for the Fairfax County Fire and Rescue Department. During these periods of financial decline, which strains public safety budgets, we need to maintain our image and garner public support. The last thing we need is the public thinking the fire service is nothing but a bunch of racist, sexist, mean spirited (even evil and criminal if some of the allegations are to be believed) good ole boys propagating a pre-civil rights era culture.
It is time to lift the “code of silence” and bring those who have done wrong to justice. There is no room in the modern fire service for people who lead by intimidation and think it is OK to humiliate and disparage those around them at will.
Should JJ and others be found guilty, they should be disciplined depending on the severity of their indiscretions and the depth of their involvement, whether that be termination, demotion or even criminal charges if warranted.

A few years back I remember seeing Chief Walsh visit Pine Ridge PSCC a few times for meetings or to talk with the UFO. The language that he'd use, right on the communications floor in full hearing of PSCC employees, was shocking to me - and I've been around police and fire personnel long enough to usually not be shocked. Once I did give him a "look" as I walked by and heard some of this, but I didn't take it any further.
My point is that sadly I'm not surprised at the allegations, and I do hope people out there in the field will step forward and bring to light any wrong-doing that has been done to them by anyone. I was always proud to be associated with the department during my 25 years in dispatch, and it makes me sad to hear about all that has apparently gone on unchecked for years and years.

Would like to be there for opening arguments, when Clarke and Iacone take the stand and when Bailey testifies. I would like to see the evidence myself to make an informed decision. On the one hand I am absolutely amazed at Bailey's memory and power of recall. Try to remember complete conversations you had 5 years ago. The issue with Walsh is he cannot operate to the current level he was promoted to. He was the third pick and was lucky to get that. He has zero ability to communicate with employees in a positive manner. The senior staff didn’t even want you in your current position, certain people even had talks with you about your attitude and how you deal with situations. You portray your "all about the job" well you can’t even do your job correctly as a manager. Stop micro-managing calls and your people; it’s funny in your law suit its states you making comments to the Safety Officer......that’s all you preach. Set the example for your shift, you wear a fleece jacket and a reflective metal hooked radio strap and no protective glove holder on your uniform belt.....really! You think you can bully people....look at your own self! This only shows you are insecure with yourself, in return you must bring everyone else down to make you feel like a "Chief Officer".
No one respects your ideas, as of now how can you come to work after saying certain comments about your own employees. You don’t think every firehouse has printed your lawsuit off and placed to over to toilet? You don’t know leadership....if you did you would not be in the situation you’re in. You say you were a drill instructor in the military.....well open your eyes they can’t even use profane language. Point is, is military and the fire service is changing! It apparent you cannot change with it, at that point you need to leave while you can on good terms. Your Aide is as guilty because he sits there and does not report your violations. What really hit me was a member of dispatch that doesn’t even know you made comments that you were making violations against SOP's on the open floor in front of employees.....do you think?

I have lived here in this county for 27 years. My question is how can someone time stamp and record these happenings for years through a note pad and people still feel it is not true? The suit names employees that made commits. "JJ Walsh" has bullet points for each comment and they didn’t even list them all! This man should not be a supervisor if found guilty. Any other county would say fire him! No....Fairfax is about sweeping it under the rug! Bad PR.....well you have it now all over the net and papers and in firehouses.
I always thought we had a top notch fire department. We have a FEMA Team that goes around the world and the county pride themselves on top service and response time.
That’s all great....but I would like good people in my home taking care of my family. After reading this I have entire different thought on what goes on in the fire and rescue service.
The three suits have shed light on what people are doing. Even at high supervisor levels. Mr. Walsh can’t respect other employees. No other business would operate in this manner. Why is the fire department different? You are like everyone else in the county, even at a higher standard.

They display patience and understanding, yet when warranted, unleash a productive, purposeful hell. They don't belittle to satisfy their own ego. They make something out of nothing. If most of these people were officers in the fire dept then aren't they obligated to report when someone breaks an SOP or Rules and Regs. 100.08 Reporting Violation
Any employee who has knowledge of other employees, individually or collectively, who are knowingly or unintentionally violating any laws or statutes, ordinances, Fairfax County Procedural Memorandums, SOPs, rules and regulations of the
department, or who are disobeying orders, shall bring any and all facts pertaining to the matter to the attention of a superior officer. The superior officer contacted shall then take appropriate action. An employee may bypass the official chain of command and directly advise the Fire Chief in writing of the violation(s).
You guys are being stupid. In order for IA to start an investigation it must be approved by the FIre Chief or Assistant Chief Dyer. So I guess JJ Teflon will most likely get away with this one too. And the arrogant bullying behavior continues.

These people are doing their job; they are reporting violations of specific SOP's. This is public knowledge in the lawsuit that has been posted on a public website and then will go to a District Court. This is "cleaning house" your superior is not doing the right thing for his people or for the citizens.

We can't continue on this way for much longer so come out and let's take back this fire department. It's ours and while we may not agree with the way people handle their affairs, we seem to all agree that our leadership has failed us and made us turn on each other. What the heck is the big deal here???? Other then banging another FRD members wife, what REALLY is the issue with JJ? Sure he cusses, calls names, etc; but IF YOU ARE DOING WHAT YOU ARE SUPPOSED TO, he doesn't treat you that way. I have worked with him a few times and never had an issue.
Exactly what we NEED are people that hold others accountable when they are not operating safe, out of shape, doing dumb things on scene, misuse sick leave, etc. I could go on and on about the REAL problems in the department.

This is basically a summary of what the plaintiff has heard not what has happened to her personally. She requested documentation of prior bad acts and paperwork to support her sexual harassment claim. It looks like the Judge ruled they were entitled to that information and that Fairfax County has not given them the information yet.

Have you actually read the lawsuits, they involve senior union guys (brothers!!!). Have you asked the firefighters (the rule following, non-violating, show up to work and not DOOPS every second day, training and not complaining, doing it in the street) what they think of the Union right now? Secondly, the union gets a "word" in on who picks a fire chief, not the final say despite those who think otherwise. You want people to come to your union meeting, try a different approach and not when the entire County is buring with litigation and name calling. And dont try to rally the troops now after numerous failures, inconsistencies, and participation in illegal activities (Gray = Safety = Wrong/overweight = jackass...for example). Wow, I can honestly say having worked with JJ for the past 3-4 years that those bullets are all true...I have heard some of those comments repeated often both in the station and on emergency scenes...When I went to his battalion I was warned that he was the BC and I said it couldn't be that bad...Oh was I wrong! True in some cases that if you do your job right he will leave you alone but sometimes he has his favorites to pick on that he just doesn't like for personal reasons and will still pick on them even if they do their job...I have never had a problem with reprimands in 20 yrs until I got to his battalion than that changed over the past 3 years...Then he was promoted and I was actually happy no more JJ as the BFC, life could be normal again...Wrong then comes the transfer because he has the power to make transfers on his shift now...Now working in an area of the county that never have before with less than 2 yrs to the big 25...Never thought this was how the end of my career would be finished out in misery because of one person, JJ...Unfortunately there are many out there he treats like that, some worse than others but no one seems to care or take notice...So yes I can't wait to leave this department at this point unless things change and soon...

Chief Mastin, if the county is found to be guilty (again) and these allegations (even 10% of them) are true please find it in your heart to forgive all those involved. From a management standpoint you know that every last guilty one of them (including yourself) should hang up the Fairfax helmet and move on. I hope to see DFC Walsh in a few years working for some loser Maryland volunteer fire company on the eastern shore. What a great selection for a deputy. Third string? Unbelievable. I do hope the media hits this fast, furiously, and moves on. For the rest of the fine folks that work at Fairfax please hold your chins high and find some way to stay focused. The Fairfax County Fire Dept. is one of the best in the nation.
Let's face it people, there are many problems with Fairfax. From promotions, laterals, TA Fraud, excessive paid OT, Alt. Placement employees (some placed in a job a monkey could do making bank $$ for years),employees with drinking problems (some rehired and sent to rehab on county $ and others kicked to the curb if they were not liked) some who have rules and some who do not. Its all about who you know, who you slept with, who kissed ass "Yes Sir, No Sir, What ever you say Sir" There are so many great employees who hold everything in high regard and then there are those who always wanted to be somebody when they grew up and firefighter was an easy in and when they did a mass hire after 911 - they took every piss ant (diversity driven hiring practice) that wanted a job and that caused all the "good ole" boys to be bumped up in a promotion to run the place. What a bunch of BS - they have created such a mess that it has gotten so out of hand that to stop the cycle now, would cost the county tax payers millions to settle and try to justify why Fairfax plays by different rules than everyone else. Why Fairfax changes the rules half way thru the game and even at the end of game will change the score to make themselves look better. Its a sick sick organization and I can only hope that heads will roll and they can get a grip on it and get some credabilty back, I'm sure DC, Alex, Prince William and a host of others are laughing their ass off at Fairfax, THE GOLDEN CHILD is being brought to its knees by its own stupid greedy cocky arrogant self.

No it has not been dismissed. Though many wish it would just go away. Sad reality folks is that wheter you agree with all the details of this lawsuit or not the FACT that the first case was won is huge for this case. From what I have heard yet not confirmed is that the county is appealing the first case. We can all go back and forth on who said what and slam each other but in the end all will be affected by these lawsuits.
Better check again...I've also heard today that the Bailey case was dismissed by the judge.

Hey "Donna Will," while we thank you for your service at DPSC, this is a firefighters' forum. Dispatchers, telecommunicators, etc. are not firefighters. Firefighters are not dispatchers. You say you overheard JJ talking in DPSC and it shocked you. Well, I have to ask you, as a member of DPSC management, what did you do to correct the problem? Did you speak to JJ? Did you make a complaint to the UFO? Did you say anything to your supervisors? Hmmmmm. If yes, and nothing happened in response, then maybe you have another issue to address. If no, then stow it. We need another "A fire truck came down my street once" story on here like we need a stick in the eye.
Stick to the dispatcher blogs and let the firefighters talk amongst themselves.

Anonymous 614: I've been here for 30 years and find your attitude and arrogance repulsive. You are not what I envision as the future leadership of this department in any capacity. I certainly hope you are not an officer, but if you are I feel a little "mentoring" in my battalion would do you a world of good.
I don't understand the problem how certain people can’t see this man has made a hostile work environment and harassed employees that he manages. I have heard numerous employees in the field from Firefighters to Battalion Chiefs saying it is no surprise to them he made those comments. How can you say those things, then have the balls to manage them and except them work with him on a fire ground and not feel threaten. One attribute of a good leader is setting the example and treating others with respect. Do you think these employees he manages respect him or want him as their leader? Times have changed just like our equipment, service delivery, response algorithms, staffing, and the WAY WE TREAT employees. This is not the Marine Corps 35 years ago; they have changed the way they do business to. Take a big gulp of your own pride and take responsibilities for your actions and try to improve your anger towards your own people. Change or step out of the way, so someone can lead this department in a new direction that we have failed to do for years.

It is truly a sad day not only for the fire service but especially for the Fairfax Department. Each and every one of you whether named in these suits or allegations are as blameworthy perhaps even more with your slanderous remarks, half truths and attacks on your fellow brothers and sisters, you’re the same ones more than likely profess the sister and brotherhood of the profession in public, but when given a chance, stab the very ones who you depend on everyday in the back in the many anonymous postings. Really! Please produce evidence that this projects a difference in the costumer outcome. Maybe we should conduct our own study that compares the polo shirt to the cotton T-shirt to help the safety of our employees to provide a safe environment…….that will be corrupt too…trust me! The City of Fairfax has the option to wear shorts and to their knowledge there has been no report from a citizen that it looks unprofessional. How is it safe to wear three layers of clothing...t-shirt, polo, and PPE on a working fire? I can prove that your body will have less stress if you only wear one layer during the summer months. I do like what Arlington went to with button ups with no dangerous pins sticking in you or getting snagged on your gear. They have good looking uniforms that their employees like to wear. We need to have badges and pins, look at other departments around you, they all have went to cloth with no metal badges....that would burn your skin in a fire...and the metal badges are not NFPA improved on fire situations. We need to look outside of Fairfax County. Why can't we change that SOP with uniforms and submit new ideas that will help us stay safe on events. If you ask any citizen if they noticed polo or a t-shirt they would not be able to tell you. We need to be professional but we need to think of the safety of our employees. When you operate on a fire or an incident for hours in turn-out gear is it safe to have three layers on or two? Can we establish a committee that can decide on what needs to be established or an outside organization? We can factor field personnel that have a real interaction with the everyday situation and not employees in the climate controlled Massey Building. I can go on about a radio strap study that shows metal hooks have nothing to do with anything. Also, keeping our radios in the "radio pocket" is a hazard and is not proven through any study. The funny thing is it is proven through another NOVA department that the radio strap is a better option than the pocket in our turn-out gear. Law-suit waiting to happen there……trust me! Another, aspect to discuss is suspenders are not required through Globe turn-out gear.....read the information J.J. we don’t need them! That is straight from Globe. It restricts your mobility and could cause a tangle hazard. We do not wear high-back pants anymore.....change with the times…another example! All other NOVA departments allow no suspenders if they have the new globe gear.
We really need to keep up with the current times of fire and EMS. Many departments had the “E-PCRs” before us we are way behind with other departments in the Commonwealth. They have their times inputted and have patient info filled in if it was a previous patient. They can fax EKG’s to the hospital…..before they get there. This provides better service delivery for the patient and the hospital for treatment…..all we worry about is t-shirts. In the big picture is that a major concern for us? Or is helping the patient in an effective manner? What’s your name….what’s your D.O.B….need your phone number and your billing address ….oh and your history…..sorry you’re having a heart attack!!!!!!!!!!!!!!! This can all be put into the system after running one event with that patient. Faster information; can project a faster patient to hospital transfer. In return this is the best outcome for the patient…..we still can’t do this with all “our money”. To top it all off is the hospital average turn-around time…….over one hour! Other departments are doings status checks with-in 20 minutes! Why does our system feel this is good for the public………………..oh yes the system is slow and does not provide the best outcome for the patient. WOW!
For a long time I resisted from posting on here because I thought it was simply a forum for "whining". Well, I have begun posting because I feel the leadership of this department, including the Union leadership if you can call it that, has failed us. Over and over again we find ourselves with issues that plague us. We can beat around the bush and say we have issues with t-shirts, ePCR's, dispatchers, or even "staff" personnel. What is it really? I could go on and on after reading some of the stuff on this particular post. Radio Straps? Give me a break. You obviously haven't been in long enough or been engaged in EVERYTHING that goes on. It makes a HUGE difference. The contractor that manages a great deal of the engineering for the radio system did do a very comprehensive study that proves a radio inside a turnout coat reduces its effectiveness and will "bonk" before another right beside it. And maybe you can ask yourself this Mr. Big Time Firefighter, how are you going to get to the radio if you need to activate your EA? What if the fire is so hot your Lapel Mic melts? Hmmm, not such a pretty picture now just so we can be cool to wear our radio inside our gear. The studies have been done. They are conclusive.
So, now that one of your hypothesis has been disproved, it is logical to conclude that your other assumptions are also incorrect. Please do us all a favor and research before you make invalid statements.
That goes for each and every one of us. We do no one any good if we don't do our research first.
I could go on. I will say that some of your assumptions and conclusions are correct but I do question your method of acquiring the data.
Let's all remember the one point you are making that I agree with 100%, take care of the citizens we are sworn to protect and provide service first, t'shirts can just get a little sweatier as we do our jobs.

Yes the radio should not be worn inside the coat, that includes the radio pocket. Get a copy of the Fairfax City radio study and you will see the radio should be worn outside the coat with the radio strap. Perhaps the same genius that decided painting black arrows on fire hose so "we" could find our way out of low/no visibility environment decided putting the radio in the coat pocket was a good idea!
Because you MIGHT not be able to see the arrows they're a bad idea?? What if you can, just barely see the arrows, then is it o.k.?? You're an idiot and if you saw the same Motorola video, made after their study, you would be convinced that your best bet is to have the radio in your radio pocket and to be ready to disconnect the mic if it burns up...what more do people need before they decide the right thing is the right thing to do??
How about finding a coupling to find your way out? Black arrows on fire hose are a bad idea! What color are the marks left by soot on a fire hose? If you had ever been in a fire hot enough to melt your mic you would remember hugging the floor face down unable to reach your radio. Perhaps the radio holsters should have a protective sleeve made from the same material as the turnout gear. After you have more than five minutes experience riding fire trucks feel free to comment!
It is confirmed there will be no further investigation as the allegations against JJ Walsh have been unfounded.

Well maybe it was unfounded due to the anynomity to the letter. If you can't stand up and show your face when you complain, then why should it be taken seriously. Also,I'll take JJ on the fireground any day of the week. Look around at some of the BC's we have working. JJ might have some rough edges, but I'll tolerate that, when my crew and I are inside a burning building. At least, he has been there and done that. So he cusses, big deal!!

Not hardly JJ. Just someone who thinks that if you are gonna whine, you should at least have the guts to sign your name. Sad state of affairs. And if his alledged affair should have kept him from getting promoted, you are dreaming. Many people , including deputy chiefs, have been promoted after having an extra marital affair. So, keep the crying towel handy, sounds like you need it.
