Bailey Case Dismissed?

We are hearing that at least a portion of the Bailey case was dismissed by a federal judge. There are a lot of rumors circulating about this - but we have yet to see any documentation. A reliable source tells us that it wasn't the entire case, it was only a portion of the case. Apparently, the same thing happened with the Gand case.

Once we get more solid information, we will share.

It was dismissed by a federal judge based on lack of evidence. He simply refused to hear it...

Now for you "Brother" bigeye.... and that is truly a joke, being you are no "Brother" of anyone...you are no better than the National Enquirer with your censorship of anything that doesn't play in to your court. You worked for JJ but refused to post anything someone may have to say positive about the man... that would have been too fair, right?

If it was dismissed by a federal judge - there would be documentation. If you have that documentation, please forward it. Otherwise, you are just another person who has heard this through the roumor mill.

I haven't censored anything here about JJ. People have posted both good and bad experiences - perhaps you need to read through the various postings before you make statements where The Big Eye has not allowed people to post positive things about JJ.

The only thing we will censor, is something that is racist, or something we know for a fact is not true. If that doesn't work for you, start your own blog!

In Dec 2010 the judge ruled that the $2mil for the lung injury shall be dismissed because she received workman's comp and disability for the injury.
The county also requested that those parts of her suit be stricken from the case. In this same ruling the judge determined that the statements regarding her lung injury shall stay in the evidence because it could be used to further justify her claim of a hostile work environment.

it is true the case was dismissed..... BIG EYE: why would anyone here have something "official" simply to put on your blog? Most if not all information here is conjecture anyway?

However, several of the named persons have been contacted by the County attorney who advised them of this...PLUS, a few of them were in court yesterday and witnessed the judge dismissing the case......sorry if that is not official enough, but likely the best this blog would or should get.

Like a prior poster said, maybe we should fault the judge and the county attorneys now too?...haha

Bottom line: believe whatever you like

This blog has posted several court documents to support topics created by The Big Eye. Perhaps you have overlooked them. With every court ruling, there are court documents. Some are saying that only a portion of the case was dismissed - others are saying the entire case dismissed. No one will know for sure until we get the actual documents, which are public record.

I suppose I set myself up for that one - allow me to elaborate. It is very difficult to draw a line on censoring our readers comments. We won't allow racial slurs. Additionally, if someone posted something that we know not to be true, we won't allow the comment. To clarify, if we, as editors of The Big Eye, receive a comment that states that one of our firefighters has died from injuries received at a fire - and we know that this same firefighter is alive and well....we will not allow the post.

The critical portion of the statement, is that we as editors KNOW that something isn't true.

And for the record - this blog is run by a few individuals. We reserve the right to manage this blog as we see fit. Just like any other entity, we may need to modify things if conditions warrant.

These are our rules. We run this place and we can make the rules. You will be subject to these rules if you want to be here. We will follow those rules that we have made unless we think that we shouldn't have to, than we will do what we want. If you call us on not following our rules we will make up new rules that match what we have decided to do.

You really believe you are doing a service to this department or its membership? You must be on crack!

We have problems just like any other department, yes maybe even more right now......but you sir are not helping nor do you have any other function than to tear it down. I and others can only hope when heads roll, yours is one of them.

Please change your name from "Brother Big Eye" to just "Big Eye" because you are no brother to anyone.

You all can bitch and moan all you want to but we all know the truth. FXCO FD has always been a good ol boys play ground. Ive been around a loooooong time. I was at 11 when the first black Firefighter arrived...wasnt pretty but everyone denied what took place. CYA. I have lost a ton of respect for the people in FRD, both at command level and at the street level. Bunch of ignorant asses. This is all playing out on the national fire press and a once fine, highly respected department is being shown for what it has always truely been. Good job.

It would seem to me (and I have been here 31 years), we are tons better in all capacities now. I worked on the Highway for a looooonnngggg time too (as you like to point out) so I don't totally buy your griping... seems like you are rambling to be honest?

The case was dismissed by the judge.

The Bailey case was referring to items and exhibits from the Getts-Bland case, and they werent actually submitted to be part of the Bailey Case.
So the judge essentially said, get your shit together, your exhibits are all over the place.

So one would assume that she will now file with the appropriate evidence and exhibits at a later date.

I gather you mean "manufacture" MORE new evidence?...Now that would be interesting, wouldn't it?

Too much money and time anyway...I think even dirt bag attorneys have to look at the cost benefit to do this...and I don't think it is there.

It's not county 1 bailey 0..there was a summary judgement, not a dismissal. The case was refiled June 9th. It was just a technical loophole for the county to buy time. Like the previous entry said, PLEASE do the proper research before jumping for joy.
